Task Force for Tariff Refund: US Supreme Court has declared the tariffs imposed by President Donald Trump unconstitutional. This decision, made by a 6-3 majority, dealt a severe blow to Trump’s tariff imposition and trade arrogance. The court held that Trump’s tariffs are not authorised under the International Emergency Economic Powers Act (IEEPA), a power reserved only for Congress.
Trump had used tariffs as a tool to promote America as “great.” Since returning to power, Trump has been using tariffs to influence other countries, impacting global trade. However, this is Trump’s first major policy to be challenged in the Supreme Court, putting an end to Trump’s tariff tactics. This landmark decision was led by former Acting Solicitor General of the United States Neal Katyal, who is of Indian origin.
Task Force for Tariff Refund: Will refund be available?

Immediately after the decision, questions arose about whether businesses and importers would receive refunds for the losses incurred by Trump‘s tariffs.
Neel Katyal has now formed a new legal team to assist businesses and importers who have suffered losses due to Trump’s tariffs. Katyal made this announcement on February 23. Katyal said on a TV program, “We did not directly demand refunds because our legal team expected that they would automatically receive them if we won the case.”
He further said, “Today we are launching a task force to fight for those refunds. If the federal government refuses to return that money, we will fight for it with all our might.”
US Tariff Refund: Trump misused Power

The court ruled that the Trump administration had abused its powers. It also reiterated that the authority to impose taxes primarily rests with Congress. This decision dealt a major blow to a trade strategy that impacted global trade and soured relations with several countries. Following this, Neel Katyal announced the formation of a legal team.
15% tariff also faces questions
It’s worth noting that, following a US court order, Trump first imposed a 10% global tariff and then increased it to 15%. Neel Katyal has now questioned the legal validity of this 15% global tariff.
He argues that the US President cannot bypass Congress and implement such sweeping measures. Katyal argues that if a policy is correct, it must be implemented through constitutional means. Indeed, the US Constitution requires such decisions to be passed by Congress, which Trump did not seek.

This means that the increased business prices have impacted consumers’ pockets, making it difficult to send money directly to them.

In 2010, former US President Barack Obama appointed Neal Katyal as his acting Solicitor General. Till date, he has fought more than 50 major cases in the US Supreme Court, which is a record for any minority attorney.
