Supreme Court on Alimony: Educated woman should seek self sufficiency

Court questions hefty alimony demands after brief marriage

Supreme Court on Alimony: In India, women's demands for alimony are rising steadily with a sharp increase in divorce cases. In one case, the Supreme Court advised a woman and expressed disapproval. When the woman asked her husband for Rs 12 crore and a BMW car as alimony, the Supreme Court told her that, as an educated individual, she should earn her own money. The court was led by Chief Justice B.R. Gavai, who emphasized that a well-educated woman ought to be responsible for her own financial support.

After 18 months of marriage, a woman filed for divorce.Following this, the woman sought alimony in the form of a BMW, a lump sum payment of Rs 12 crore, and an apartment in Mumbai's Kalpataru Complex.

However, a bench headed by Chief Justice B.R. Gavai said that you are an MBA degree holder from the IT sector. Then why don't you work? Along with this, the court has termed the financial demands of the woman as too much considering the duration of the marriage.

Supreme Court on Alimony: Woman claims that husband is very rich

The woman claims that her husband has enormous wealth. In court, the woman denied her husband's allegations of schizophrenia and claimed to be in excellent health. Madhavi Divan, a senior advocate, countered that the husband's expectations were unreasonable. She claims that the husband made ₹2.5 crores in 2015–16, but the wife also has two parking spaces and her own apartment. In addition, the requested BMW is ten years old and was junked a long time ago.

Supreme Court made this  proposal 

The woman also argued that she is facing difficulty in getting a job because of the FIR lodged by her husband. On this, the court said that cancellation of the FIR can also be considered. The Chief Justice said that we will cancel that too. While reserving the order, the Supreme Court has given two options to the woman. The court said that she should either take the flat or a lump sum amount of Rs 4 crore so that she can move forward in life.
