The Supreme Court issued its decision regarding the 2019 demolition of a house in Maharajganj, Uttar Pradesh, to facilitate road expansion in the area.
The country's supreme court issued its ruling on the UP Government's bulldozer operations on November 6, 2024. In 2019, the administration led by Yogi Adityanath demolished several houses illegally to expand roads in Uttar Pradesh. This action displeased and dissatisfied the Supreme Court, leading it to direct all states and union territories to refrain from such practices in their governance.
Chief Justice DY Chandrachud, along with the bench including JB Pardiwala and Manoj Misra, has ordered the government to pay 25 lakhs in compensation to the homeowner whose property was demolished in 2019. The bench reprimanded Uttar Pradesh's advocate, stating that the administration should have at least given the family living in the house some time, considering there are many household fixtures in the property, and inquired about these fixtures.
The bench directed the Chief Secretary of Uttar Pradesh to guarantee a comprehensive investigation of the house demolitions in the Maharajganj area and to carry out fair procedures. The bench also discussed the necessary steps or follow-ups required before expanding the roads. Additionally, the bench asked the states to review maps and blueprints of the roads to identify any potential exploitation.
If anyone is found misusing the roads, the first step is to issue a notice to the individual. If the notice is disputed by the recipient, necessary actions will be taken in accordance with the state's principles of natural justice. If the person is proven guilty of exploitation, a notice will be issued in line with the house vacation procedure.
